Quality Assurance 

 The Nomadic Audio Speaker Suitcase (the "Speakase") has been tested, using stringent quality control standards in order to ensure that it meets the required standards demanded by frequent travelers. 


Limited One Year Warranty

If a problem occurs with the Speakase and the problem is caused by manufacturing defects in material and workmanship, Nomadic Audio will, in its discretion, either fix or replace the Speakase in accordance with the warranty terms and conditions stated herein. The warranty provided for herein applies only to and extends for the lifetime of the first purchaser of the Speakase. 


This warranty covers only manufacturing defects and does not cover any damage caused by misuse (such as transportation of unusual items), neglect, accidents, abrasion, exposure to extreme temperatures, solvents, acids, water, normal wear and tear or transport damage (by airlines for example). While non-warranty maintenance or repairs on your Speakase can be performed by any company, Nomadic Audio requires that you use only an approved Nomadic Audio service provider ("Service Provider") for warranty repairs. Improper or incorrectly performed maintenance or repairs void this warranty.

Incidental and consequential damages are expressly disclaimed. Labor charges and damages attributable to work performed by anyone other than a Service Provider are not covered by this warranty. To the extent permitted by applicable law, any implied warranties are hereby excluded. The warranty provided herein is limited to the value of the Speakase. Manufacturing specifications are subject to change without notice. 


The Speakase locks are intended only to prevent accidental opening and cannot necessarily prevent theft of the Speakase or its contents, breakage or entry by airline or airport personnel or governmental authorities. Inspect your Speakase immediately after handling by anyone other than you. If damaged in transit, submit a claim to the transit company (which is insured against damaging your product) at the place of arrival, if possible, before clearing customs. 


This warranty is intended to give you specific legal rights. In addition to the rights described herein, you may also have other rights that vary from state to state or country to country with respect to the exclusion or application of implied warranties, incidental and consequential damages and repair and replacement. Consequently, the limitations or exclusions specifically contained in this warranty may not be applicable to you. 


GLOBAL WARRANTY 

This One-Year Limited Warranty (the “Warranty”) is a manufacturer's warranty provided by Nomadic Audio for the Nomadic Audio Speaker (the “SB1”).The Warranty is in addition to, and not instead of, rights provided by consumer law and consumers have the right to choose whether to claim service under the Warranty or under their consumer rights law. For further information about consumer law, please contact your local consumer organization. 


THE FOLLOWING IS COVERED BY THE WARRANTY: 

Nomadic Audio hereby warrants that the SB1, for a period of one (1) year from the date of original purchase from Nomadic Audio's website (the Website) or its official resellers, is without defects in materials and workmanship, provided however that the SB1 is only used in accordance with published guidelines from Nomadic Audio for the SB1, including the SB1’s user manuals, technical specifications etc' and subject to the limitations set forth in this document.The Warranty only applies to SB1 you purchased for your own use and not for resale.Similarly, the warranty provided for herein applies only to and extends for the lifetime of the first purchaser of the SB1.


THE FOLLOWING IS NOT COVERED BY THE WARRANTY 

The Warranty does not apply to: (a) products that were bought through other channels than the ones mentioned above, (b) problems that occur more thanone (1) year after the date of original purchase from Nomadic Audio via the Website or it’s official resellers, (c) consumable parts, such as batteries or protective coatings; (d) cosmetic damage, including but not limited to scratches, dents and broken plastic; (e) damage caused by external cause, including but not limited to accident, abuse, misuse, liquid contact, fire; (f) damage caused by operating or use of the SB1 other than in accordance with published guidelines from Nomadic Audio for the SB1, including the SB1’s user manuals, technical specifications, etc. (please note: you may not open or disassemble the SB1 in any other way than as explicitly described in the SB1’s user manual; (g) a SB1 that has been modified; (h) defects caused by normal wear and tear or otherwise due to the normal aging; or (i) a SB1 that is stolen, or where Nomadic Audio or its Authorised Service Provider has reason to believe that it is stolen. 


Please note that only Nomadic Audio and/or its Authorized Service Provider may perform service on the SB1. 


Warranty cover will be void if repair has been made or attempted by any unauthorized service centre.Furthermore, the Warranty does not apply to any hardware products other than the SB1.Nomadic Audio is not liable for reimbursements, claims and damages where the Warranty does not apply. As concerns limitations of liability, please see below.


WHAT WILL BE DONE IN THE EVENT OF A WARRANTY CLAIM? 

 If you submit a valid claim under the Warranty, Nomadic Audio will, at its option:(a) repair your SB1 using new and/or previously used parts that are equivalent to new in performance and reliability, (b) replace your SB1 with a product that is at least functionally equivalent to the SB1 and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (c) refund your purchase price in exchange for the return of your SB1.When a SB1 or part thereof is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes Nomadic Audio’s property. A repaired or replaced SB1 assumes the remaining Warranty of the original SB1 or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. 


THE WARRANTY SERVICE 

For information related to the Warranty service, please contact Nomadic Audio via e-mail at the address stated at the website.Before receiving Warranty service you may be asked to present proof of purchase details, provide information to diagnose potential issues with your SB1 and to follow procedures and instructions for obtaining Warranty service, such as following instructions for packing and shipping the SB1 when receiving mail-in service as described below.Nomadic Audio will at its option, depending on the individual circumstances, provide Warranty service through one or more of the following options:Nomadic Audio may request that you return your SB1 to Nomadic Audio or its Authorized Service Provider. After Warranty service, you may upon notice retrieve the SB1 from the Nomadic Audio or its Authorized Service Provider, or the SB1 will be sent to you directly. 


Nomadic Audiomay elect to send you prepaid waybills, so that you may ship your SB1 to a Nomadic Audio and/or its Authorized Service Provider. Please note that you will need to provide your own packing material and that the packaging of the SB1 is required to fulfil the specifications set forth by the relevant shipping company. After Warranty service, the SB1 will be sent to you.Nomadic Audio and/or its Authorized Service Provider may provide you with a replacement product, part or accessory with instructions for replacement. For DIY service, Nomadic Audio and/or its Authorised Service Provider may require return of the replaced product, part or accessory, and Nomadic Audio and/or its Authorized Service Provider may therefore require a credit card authorization, in an amount corresponding to the price of the replacement product, part or accessory, as security for such return. If you follow the request and return the replaced product, part or accessory, Nomadic Audio and/or its Authorized Service Provider will cancel the credit card authorization. If you fail to follow the request Nomadic Audio and/or its Authorized Service Provider the right to charge your credit card for the authorized amount. 


Note: Nomadic Audio and/or its Authorized Service Provider is not responsible for any costs, including labour costs, you incur relating to the DIY service.Service options may be limited if requesting service in a country that is not the country of purchase for the SB1. In the event that service for the SB1 is not available in such country, you may contact Nomadic Audio to receive information related to service and any additional charges for shipping and handling that may apply before rendering service. You may seek service in a country that is not the country of purchase and in such case you are responsible for all custom duties, VAT and other associated taxes and charges and for complying with all import and export laws and regulations applicable.


LIMITATION OF LIABILITY 

A) Other than the mandatory consumer law rights to which you are entitled, all warranties, conditions and other terms not set out in the Warranty are excluded from the Warranty. As a result, this Warranty is your exclusive warranty and replaces all other warranties or conditions, express or implied, including, but not limited to, any implied warranties or conditions of merchantability or fitness for a particular purpose.Some countries do not allow limitations on warranties or on how long warranties, conditions and/or implied terms may last, in that event, such warranties apply only to the extent and for such duration as required by law and are limited in duration to the warranty period, if applicable under such law. 


B) Disclaimer in relation to data:Nomadic audio does not warrant, represent or undertake that it will be able to repair or replace any SB1 under the Warranty without risk to and / or loss of information and / or data stored on the SB1. 


C) Limitation of liability: 

In no event shall Nomadic Audio be liable for 

1.   any losses or damages related to the defects in materials and workmanship of the SB1; 

2.   any losses that were not caused by Nomadic Audio breach of the Warranty; 

3.   any loss or damage that was not, at the time of your purchase of the SB1, a reasonably foreseeable consequence of Nomadic Audio breaching the Warranty; or 

4.   losses relating to any business of yours, loss of profits, loss of data or loss of opportunity.
